Terms and Conditions of Use

1. Introduction and Acceptance
Welcome to HeyDoctor. These Terms and Conditions (Terms) govern your access to and use of the HeyDoctor web application, including all content, features, and services offered through the platform (collectively, the Service).
The Service is operated by Marco Santonocito, with registered address at Piazzetta Ado Furlan 4, 33170 Pordenone (PN), Italy, VAT number (Partita IVA) 01992590933 (hereinafter Operator, we, us, or our).
By accessing or using HeyDoctor, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree with any part of these Terms, you must not use the Service.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email where possible. Your continued use of the Service after any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
2. Eligibility
The Service is available only to individuals who are at least 18 years of age. By using HeyDoctor, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you are prohibited from using the Service.
3. Nature of the Service --- Important Medical Disclaimer
HeyDoctor is an entertainment and educational game. It is not a medical device, diagnostic tool, clinical decision-support system, or substitute for professional medical advice, diagnosis, or treatment.
The clinical cases, AI-generated patient responses, investigation results, diagnoses, and explanations presented within HeyDoctor are fictional, simplified, and designed for gameplay purposes. They do not reflect real patients, real clinical encounters, or current clinical guidelines.
You must never rely on any information provided by HeyDoctor to make real-world medical decisions. Always seek the advice of a qualified healthcare professional for any medical condition or concern. If you are experiencing a medical emergency, call your local emergency number immediately.
HeyDoctor does not provide Continuing Medical Education (CME) or Continuing Professional Development (CPD) credits. No certification, accreditation, or professional qualification is awarded through use of the Service.
The Operator expressly disclaims all liability arising from any reliance placed on the content of HeyDoctor by any user or any person who may be informed of its contents.
4. Account and Access
4.1 Device-Based Identification
HeyDoctor uses anonymous, device-based identification (UUID) to manage your game sessions and progress. You are not required to create an account or provide personal information to use the Service. Your progress, scores, and streaks are tied to your device.
4.2 Your Responsibilities
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service;
- Use automated scripts, bots, or other means to interact with the Service or to circumvent message limits, rate limits, or other usage restrictions;
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure;
- Attempt to gain unauthorised access to any part of the Service, other users data, or the Operators systems;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Use the Service for any commercial purpose without the Operators prior written consent;
- Share, distribute, or publicly disclose daily case solutions, diagnoses, or AI patient responses before the 24-hour case period has ended, in a manner that spoils the experience for other players.
5. The Game
5.1 Daily Cases
Each day at 00:00 UTC, a new clinical case is released globally. All players encounter the same case on the same day. Each case remains active for 24 hours.
5.2 AI Patient Interactions
HeyDoctor features an AI-powered simulated patient. The AI patient responds based on a pre-authored Clinical Case Document (CCD) and does not generate medical information beyond its scripted parameters. AI responses may occasionally be imperfect, inconsistent, or unexpected. The Operator does not guarantee the accuracy, completeness, or clinical appropriateness of any AI-generated response.
5.3 Message Limits
All players are limited to 30 messages per case. Messages include both patient dialogue and clinical investigation requests. When your message limit is exhausted, you must submit a final diagnosis.
5.4 Diagnosis Submission
You may submit up to 3 diagnosis attempts per case. Diagnoses are selected from a curated list of medical conditions via searchable autocomplete. The list is maintained at the Operators sole discretion and may be updated at any time.
5.5 Scoring and Leaderboards
Scores are calculated server-side and are final. The Operator reserves the right to adjust scoring algorithms, remove fraudulent scores, or reset leaderboards at any time without prior notice. Leaderboard positions do not confer any prize, reward, or entitlement.
6. Subscriptions and Payments
6.1 Free tier access
Without a HeyDoctor Pro subscription, you may play one (1) case per calendar week. A week runs from Monday through Sunday in Coordinated Universal Time (UTC). Once you have started a case in a given UTC week, starting additional cases in that week requires a Pro subscription until the next UTC week begins. No payment information is required to use the free tier.
6.2 HeyDoctor Pro Subscription
HeyDoctor Pro is offered at the price shown at checkout (subject to change with reasonable notice). As of the date of these Terms, the standard monthly plan is €9.99 per month.
Prices are inclusive of VAT where applicable. The Operator reserves the right to adjust pricing. Any price increase will apply only from the next billing cycle and will be communicated at least 30 days in advance.
6.3 Payment Processing
Payments are processed securely through Stripe. The Operator does not store or have direct access to your full payment card details. By subscribing, you agree to Stripes terms of service in addition to these Terms.
6.4 Automatic Renewal
Subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled before the renewal date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to Pro features until that date.
6.5 Refund Policy
Due to the digital nature of the Service, the following refund policy applies:
- If you have not used any Pro features (played any cases as a Pro subscriber) since your most recent payment, you may request a full refund within 14 days of that payment.
- If you have used Pro features, refunds are generally not available, as the digital content has been consumed. However, we will consider refund requests on a case-by-case basis in circumstances such as technical issues that prevented you from using the Service.
- To request a refund, contact us at support email. We aim to process all refund requests within 14 business days.
- This policy does not affect your statutory rights under Italian or European Union consumer protection law, including the right of withdrawal under Directive 2011/83/EU, to the extent applicable.
6.6 Free-Tier Access
The free tier is described in section 6.1. The Operator reserves the right to modify free-tier access with reasonable notice.
7. Intellectual Property
7.1 Operators Intellectual Property
All content within HeyDoctor --- including but not limited to Clinical Case Documents (CCDs), clinical explanations, diagnosis lists, AI system prompts, game mechanics, scoring algorithms, user interface designs, graphics, logos, trademarks, and software code --- is the exclusive property of the Operator or its licensors and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms. This licence does not include the right to:
- Copy, reproduce, distribute, or publicly display any content from the Service;
- Create derivative works based on the Service or its content;
- Use any data mining, scraping, or similar data-gathering methods on the Service;
- Download, store, or cache Clinical Case Documents, clinical explanations, or diagnosis data for use outside the Service.
7.2 Clinical Case Documents
Clinical Case Documents are proprietary content authored, reviewed, and curated by the Operators content team. CCDs and all associated materials (including but not limited to patient histories, investigation results, clinical explanations, and learning points) are protected works. Unauthorised reproduction, distribution, or commercial use of CCDs is strictly prohibited.
7.3 User-Generated Content
Messages you send to the AI patient during gameplay (Player Messages) are processed to deliver the Service. By using HeyDoctor, you grant the Operator a worldwide, royalty-free, non-exclusive licence to use, store, and analyse Player Messages for the following purposes:
- Delivering and operating the Service (including generating AI responses);
- Quality assurance and review of AI patient performance;
- Internal research to improve the Service, including AI response quality, clinical accuracy, and game design.
Player Messages will not be sold to third parties or used for purposes other than those listed above. Player Messages may be reviewed by authorised personnel in anonymised or pseudonymised form. The Operator will make reasonable efforts to remove or anonymise any personally identifiable information contained in Player Messages before using them for quality assurance or research.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review the Privacy Policy carefully. By using the Service, you consent to the practices described therein.
9. Third-Party Services
The Service relies on third-party providers, including but not limited to:
- Anthropic (AI model provider --- Claude Sonnet 4);
- Stripe (payment processing);
- Vercel (hosting);
- PostHog (analytics);
- Sentry (error monitoring).
Your use of the Service may be subject to the terms and privacy policies of these third-party providers. The Operator is not responsible for the acts or omissions of any third-party provider, including any interruption or degradation of the Service caused by third-party failures.
10. Beta Features and Early Access
From time to time, the Operator may offer features, content, or functionality designated as beta, early access, experimental, or similar labels (Beta Features). Beta Features are provided on an as-is basis without any warranty. The Operator makes no commitment regarding the availability, reliability, or continuity of Beta Features. Beta Features may be modified, suspended, or removed at any time without notice.
By using Beta Features, you acknowledge and accept that they may contain errors, bugs, or inaccuracies, and that your use is at your own risk. Feedback you provide regarding Beta Features may be used by the Operator without restriction or compensation.
11. Availability and Modifications
The Operator strives to maintain continuous availability of the Service but does not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond the Operators control.
The Operator reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. This includes changes to game mechanics, scoring, message limits, subscription features, pricing, and content. The Operator shall not be liable for any modification, suspension, or discontinuation of the Service.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided as is and as available without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
- The Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising from your use of or inability to use the Service.
- The Operators total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you have paid to the Operator in the 12 months preceding the event giving rise to the claim, or €50, whichever is greater.
- The Operator assumes no liability whatsoever for any medical decisions, clinical actions, or health outcomes that may be influenced by, associated with, or attributed to your use of HeyDoctor.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Operator and its affiliates, officers, agents, and contractors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service;
- Your breach of these Terms;
- Any content you submit through the Service;
- Any medical or clinical decisions made in reliance on content from the Service.
14. Termination
The Operator may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, abuse of the Service, or conduct harmful to other users or the Operators interests.
Upon termination, your licence to use the Service is immediately revoked. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 3 (Medical Disclaimer), 7 (Intellectual Property), 12 (Limitation of Liability), 13 (Indemnification), and 15 (Governing Law).
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Italy, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Pordenone, Italy, unless mandatory consumer protection rules of your country of residence provide otherwise.
For consumers resident in the European Union: you may also submit disputes to the European Commissions Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. This does not affect your right to bring proceedings before the competent courts.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the Service and supersede all prior agreements, understandings, or representations.
16.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
16.3 Waiver
The failure of the Operator to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.4 Assignment
The Operator may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer your rights or obligations under these Terms without the Operators prior written consent.
16.5 Force Majeure
The Operator shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, or third-party service disruptions.
16.6 Language
These Terms are drafted in the English language. In the event of any discrepancy between translated versions, the English version shall prevail.
